Письмо поддержки проекта резолюции по признанию роли правозащитников и необходимости их защиты
В настоящее время Третий комитет Генеральной ассамблеи ООН работает над текстом резолюции «Признание роли правозащитников и необходимость их защиты», принятие которой мы ожидаем 25 ноября 2015 года. Мы обращаемся к вам как правозащитники и организации гражданского общества во всем мире, работающие на национальном, региональном и международном уровнях, и призываем Ваше правительство поддержать резолюцию и отклонить поправки, предложенные Африканской группой, Китаем и Ираном [Изменения, содержащиеся в документах ООН A/C.3/70/L.69 – L.107, смотреть здесь].
Среди прочего поправки убирают ссылки на законность деятельности правозащитников, ослабляют важность знания языка при осуществлении защиты и удаляют целый параграф, подчеркивающий важность борьбы с безнаказанностью за нарушения прав правозащитников и необходимость обеспечения адекватных мер безопасности при ведении судебного процесса. Призыв с требованием освобождения правозащитников, задержанных или осужденных в нарушение международных правовых норм, соблюдения их прав и фундаментальных свобод также предложено удалить. При этом вводится тезис о том, что страны-участники должны лишь поддержать и обеспечить деятельность правозащитников «должным образом», а не в соответствии с Декларацией ООН о правозащитниках и другими обязательствами, вытекающими из норм международного права.
Правозащитники вносят весомый вклад в продвижение и уважение прав человека, демократических процессов, обеспечение и поддержание мира и безопасности, развитие наших стран. Однако в своей деятельности правозащитники зачастую сталкиваются с различного рода опасностями и нарушением своих прав со стороны государственных и негосударственных органов. Страны-участники должны признать роль правозащитников и те специфические риски, с которыми они сталкиваются, и взять на себя обязательства по обеспечению их безопасности.
Пятнадцать лет назад все страны одобрили Декларацию ООН о правозащитниках, включая и обязательство по обеспечению безопасности правозащитников. Значимость данного обязательства была неоднократно подчеркнута в соответствующих резолюциях Генеральной ассамблеи и Совета по правам человека. Именно поэтому мы чрезвычайно озабочены тем, что вышеупомянутые делегации возражают против некоторых ключевых элементов резолюции.
Основываясь на комментариях более 500 правозащитников из 111 государств, Специальный докладчик по вопросам защиты прав правозащитников обнаружил, что в подавляющем большинстве стран ситуация с правами правозащитников ухудшается как на законодательном уровне, так и на практике. Он подтвердил, что низкий уровень заботы о безопасности жизненно важной и законной правозащитной деятельности наряду с отсутствием политических обязательств и слабых институциональных механизмов их защиты подвергает правозащитников, организации, в которых они работают, и их семьи возрастающему риску [Доклад Специального докладчика по вопросам защиты прав правозащитников Генеральной Ассамблее ООН смотреть здесь].
Проект представленной резолюции содержит некоторое число примеров, представленных правозащитниками, а также рекомендации государствам и другим участниками процесса. Важно отметить, что текст этого года фокусируется на механизмах реализации самой резолюции. Мы надеемся, что государства-участники и другие вовлеченные стороны предпримут усилия непосредственно для обеспечения выполнения требования резолюции.
Мы призываем государства продолжать исполнять свои обязательства по обеспечению прав человека, предпринимать конкретные шаги в целях обеспечения безопасности правозащитников, поддержать данную резолюцию и не допустить принятия ослабляющих её поправок.
