Russia is trying to cover up human rights violations in Crimea
On the list of undesirable organizations in Russia, the legal validity of the Russian courts, as well as the settlement of disputes between States at the international level in an interview with TV presenter Aleksandrom Yankovskim broadcast SK says human rights activist and coordinator of the Crimean field mission in Ukraine Olga Skrypnyk.
Chairman of the Liberal Democratic Party Vladimir Zhirinovsky supported the creation of the so-called patriotic top sheet. This is a list of non-profit organizations, which, in its opinion, harm Russia. The preliminary list of hit and the Crimean field mission on Human Rights. What do you think, why your organization made this list?
This suggests recognition effectiveness. We publish truthful information about human rights violations in the Crimea. Naturally, the Russian regime is not satisfied with this state of affairs. They are accustomed to the fact that it is necessary to hide the truth and distort. of our activities are not satisfied. They want to show in the Crimea beautiful picture, but it does not work. Moreover, the theme of human rights are interested in all international bodies. The standard practice of the Russian Federation is that they clean all who disagree with them. And it all begins with such statements Zhirinovsky. It is clear that no one took them seriously does not apply. However, if we analyze the recent actions of Russia, we see that very often delusional ideas Zhirinovsky subsequently implemented. Some of the organizations that are included in this list, we absolutely do not know. Probably, This is the internal logic of Zhirinovsky. Firstly, there is the American organization. This is understandable because the United States – the main enemy of Russia. Other organizations may have favored some idea of national revival and protection of certain nations. There are organizations that defend the rights of a particular ethnic group that does not suit the Russian Federation, as they are building the “Russian world”. It is unclear why we got there. We have no US funding if they wanted to bring to this. We simply publish information that is not satisfied with the current regime. First of all, it will affect our Russian colleagues, who are members of the Crimean field mission. advocated some idea of national revival and protection of certain nations. What is the status of your organization?
Crimean field mission has no legal status. We are not a government agency. We are an international coalition as to include human rights activists from different countries. Basically, it is Ukraine, Russia, sometimes – Belarus. We – are individual human rights defenders. We do not have any legal status. In this list, such an interpretation of what they can contribute to absolutely any organization that does not even have a legal status. International law says that the freedom of assembly and association exists, regardless of legal status. Therefore, Russia may refer to this fact. When you find yourself in this list, there is a trial, after which come the consequences for those people who belong to this organization, as well as for those who cooperate with it. This can be a fine or imprisonment.
Does this bill passed legal review?
There the Venice Commission, which is an expert body. To pass the Venice Commission, it is necessary to initiate this test anyone from the state. I doubt that the Russian government will initiate such a review. After the Russian Federation did not appear at the PACE, I do not think that it will appeal to the European authorities. Also expertise is the Constitutional Court. He must ensure that the laws comply with the Constitution. But it is not known whether there is justice in this court. Not servicing if it interests the current regime?
I understand that this may be something to do only your colleagues – Russian human rights activists. Is it possible to file a lawsuit against the abolition of this law?
If the individual person harmed by this law, he can appeal to the European Court of Human Rights. This so-called individual complaint. There is another way. Certain international organizations – the UN, the Council of Europe, the European Union – could put pressure on Russia. By the way, in the latest PACE resolution, which was adopted in June, there was a point which concerned the powers of the Russian Federation in the Council of Europe. They say there that the organizations of the unwanted law is dangerous, demanding to cancel it. Perhaps the pressure of international organizations is somehow able to influence the situation. But this is only possible if Russia has set up at least for some dialogue, and still considers that in some way dependent on Europe. Otherwise, I do not think this is the pressure in the near future may seriously affect it.
The Verkhovna Rada of Ukraine made the President of the European Parliament Martin Schulz. He said that it is necessary to negotiate with the Russian Federation. Does she agree the Russian Federation?
The European Council also decided that in order to completely eliminate the powers of the Russian Federation. She was left without voting rights, but it is, for example, has the right to attend the sessions. She did not come to these sessions. However, there also has been said that it is necessary to leave the door open for dialogue with Russia. The European institutions are accustomed to act in dialogue, they are always looking for some kind of diplomatic platform for negotiations. The problem is that in the last two years, Russia is not set to the dialogues.
Russian Consumer Rights Protection Society is going to file a lawsuit against the Russian Federation. Their site was closed at the request of Roskomnadzor, as they posted a memo to the Russians, who are traveling to the occupied territory of Crimea. There was a speech about what they can do on the peninsula, they are forced to enter through the Ukrainian territory. they also recommend not to buy anything from real estate in Crimea, because it is against the law. In your opinion, is there any prospects in this lawsuit?
From the point of view of the legal approach, there is a plus, because people are trying legal way to show the injustice and illegality of the decision itself, the Russian Federation. In the Soviet Union, the human rights movement was conceived on the fact that they have started to demand compliance with the rules itself, the Constitution of the USSR. What happened in the Crimea, the Russian Federation violates the law. Is what they are trying to prove.
Are there any legal mechanism for the settlement of disputes between States in the case of Ukraine and Russia?
Dispute settlement is possible if there is some agreement between the two countries. In this case, Ukraine’s position is unambiguous. But there is a higher level of position – a UN resolution, in which it was clearly stated on the territorial integrity of Ukraine. Therefore, our country can not in any way to change this limit, because it would break both their own laws and UN resolutions. There are international courts, because there are inter-state complaints. In this case it is better to conduct a conversation with the Ministry of Justice, because they have a department that deals with this. As far as I know, from the Ukraine has an international appeal was filed. It is also possible to create separate tribunals. When Ukraine had our American colleagues, they talked about the need for a separate International Court of Crimea. Ukraine itself is not used today all existing tools. Many of them started on the initiative of the injured party. It is necessary that Ukraine initiated these mechanisms.
